a. What these terms cover. These are the terms on which we make our services and digital content available to you (“You”).

b. Why you should read them. Please read these Terms carefully before registering to use the Mynd.ch Service. These Terms of Use tell you who we are, how we make our services and content available to You, how we (including You) can change or terminate the contractual relationship, what to do if there is a problem, and other important information. If you believe that these terms contain an error or if you have any questions, please do not hesitate to contact us.

2. Who we are and how you can reach us​

a. Who we are. mynd.ch is a Service belonging to Groupe Mutuel Services SA (“Groupe Mutuel”) a company registered in Switzerland, whose company identification number is CHE-103.118.779 and whose registered office is located at rue des Cèdres 5, 1919 Martigny a company registered in Switzerland.

b. How to contact us. You can contact us by e-mail at info@mynd.ch or by post at mynd.ch, Groupe Mutuel Services SA, Rue des Cèdres 5, 1919 Martigny.

c. How we can contact you. If we wish to contact you, we will do so by telephone, by video call (only in the case of prearranged coaching sessions) or via the e-mail or postal address you have provided.

d. When we use the expression “in writing”, this also includes email.

3. Our agreement with you

a. By entering your data and registering for the Service, related content and services and clicking on “I agree” below, you enter into a contract with us on the basis of the conditions set out below in these Terms of Use and you expressly agree to be bound by these Terms of Use and by the mynd.ch Privacy Policy, constituting the entire contract between you and Groupe Mutuel with respect to mynd.ch.

b. Our services (including our website and its content) are intended for personal use by residents of Switzerland only and are not offered abroad.

4. Specific services

a. “The Service” in relation to these terms and conditions refers to the digital services, coaching services and all content available via the mynd.ch Platform.

b. The Services consist, among other things, of (i) putting advisors (the “Coaches”) in paid contact with you when you request advice via the Platform, and (ii) providing adequate communication channels for the digital use of the coaching services. Bringing you into contact or providing psychological treatment is not part of the content of the Platform’s services.

c. After a first contact (the “first contact”) and when you are looking for coaching services, you have the possibility to communicate via a personalised user interface with a specific Coach in order to call upon (further) online advice. This requires your registration on the platform. After this initial contact, the use of the services of a Coach is subject to a fee. You and the selected Coach each have your own user interface for communication. A detailed presentation and explanation of the services can be found on the mynd.ch website. It is your own responsibility to inform yourself about the content of the services offered by mynd.ch before using them.

d. We reserve the right to make changes to the website, services (including coaching) or content from time to time in order to update it in line with developments in scientific knowledge, to improve its user-friendliness or to comply with legal changes. You may also need to update your profile/account or add additional content to optimise your use and results of the Service.

e. Coaches will be assigned to you according to your desired availability. A Coach assigned to you may view ALL data that you have registered or that has been provided to the Service, unless you specify otherwise when providing the data. You must select the appropriate privacy settings when entering your data into the application if you do not wish our Coaches to have access to this information. You can also contact dataprotection@mynd.ch if you need help with the privacy settings.

f. Appointments with the Coach will be made by telephone or video at the agreed time and date. You can check the availability of your Coach for appointments via the platform. If a booked appointment has to be cancelled by the Coach, you will receive an email notification at least one hour before the booked appointment. All sessions cancelled by the Coach can be postponed to another appointment. If you need to cancel or reschedule a session, you must do so as soon as possible, or at least 24 hours before the coaching session. If you do not cancel an appointment at least 24 hours in advance and do not respond to a phone call received as a booked appointment, that booked appointment will still be deducted from your appointment credit.

g. If you wish to change coaches for any reason, you can request a change at any time at info@mynd.ch. Please note that we have a limited number of Coaches and we may not be able to consider a change of Coach in all cases.

h. You must register in order to use the Services. The use of our Services is not permitted for anyone under the age of 18. By registering as a user, you warrant that all information provided about you is correct. We reserve the right to take all appropriate measures in the event that we become aware of any misleading or deceptive use of our Service (e.g. immediate account closure with no right to reimbursement).

Use of the Services is only possible with prior registration on the Platform and acceptance of these Terms of Use, the code of conduct and the privacy policy of mynd.ch in their current valid version. As a registered user, you are granted a user account for an unlimited period of time and may only have one user account, respectively multiple registrations are not permitted.

j. During the registration procedure on the Platform, you must enter your first and last name as well as a freely selectable password. In order to avoid abuse, you must not transfer your user account and all associated content to a third party. Keep the user name and password strictly confidential and do not make them accessible to third parties. If you suspect that a third party has gained access to your password, you must inform mynd.ch immediately so that the password can be blocked or changed. In the event of misuse, you are liable in accordance with the precautions you have taken.

k. Depending on the way you use the service and the devices on which you use it, you may incur additional costs for Internet or mobile connections (e.g. data roaming), which will be charged to you by your mobile and/or Internet provider.

l. As a mere contact tool and access service provider, mynd.ch is only responsible for the availability of the platform from a technical point of view and not for the accuracy or quality of the information provided by the coaches. mynd.ch is not aware of the importance or content of an accompaniment service and the information provided by the coaches, nor does it check the veracity of this information. The evaluation of the competence of the coaches is your responsibility.

m. A coaching service is only provided in the context of the relationship between you and your coach. The rights and obligations as well as the claims resulting from a coaching service and the information provided therein therefore only exist between you and your Coach.

n. By registering, creating a user account and using the Services, you agree to the collection, processing and use of your personal data in accordance with the mynd.ch privacy policy.

o. By registering, creating a user account and using the Services, you confirm that you have the legal capacity to use the Services in accordance with the provisions of applicable law. Persons under the age of 18 are not permitted to use the Services.

p. In order to be able to use our Services without problems, you will need state-of-the-art technology and access to the Internet. We are not able to guarantee you complete protection against viruses and other technical risks. We accept no liability for any interruption or malfunctioning when accessing our Services.

5. This website and the Platform do NOT offer medical advice.

We inform you that the information provided by a Coach via the Platform does not replace a psychological follow-up or therapy carried out by a professional. You are reminded that following the advice given is not the responsibility of a coach and that you act under your own responsibility in this respect.


All of the Services offered on the Platform (online coaching support) do not constitute medical/psychological follow-up/consultation and/or therapy and are not intended to replace it in whole or in part. In particular, registration on the Platform does not replace a consultation with a doctor or a psychologist/psychiatrist. It is strongly recommended to consult a professionally competent and qualified doctor or specialist on site if necessary.

a. All documents provided through the service, such as texts, treatment suggestions or hypotheses, dosage suggestions or hypotheses, results, tables, charts, graphs, photographs, images, advice, communications and all other documents provided are for information and educational purposes only and are not a substitute for professional medical advice or treatment. Always seek the advice of your physician or other qualified health care provider with any questions about your health. Never disregard or delay seeking professional medical advice based on information obtained through the service.

b. If you think you have a medical emergency or need treatment, call your doctor or local emergency service immediately. Groupe Mutuel and mynd.ch do not recommend or endorse any specific test, doctor, product, procedure, advice or other information that may be mentioned on the website. You rely on information provided by mynd.ch or any member of the management team at your own risk, although we always ensure that our services are provided with reasonable skill and care and in accordance with accepted medical practice and your rights as a user.

6. Acceptable and lawful use of the service

a. You may not post or upload through the Service any information or other content that (a) is false, inaccurate or misleading; (b) is obscene or offensive; (c) infringes any copyright, patent, trademark, trade secret or other proprietary rights of any third party or violates the publicity or privacy rights of any third party; or (d) is defamatory, threatening, abusive or hateful, or contains pornography or other illegal content. You may not interfere with other Users’ use of the Service or the Coach’s provision of the Service (for example, by harassing, threatening, abusing, abusive, offensive, advertising, openly promoting personal interests or stalking another User or the Coach, including the use of bigotry, racism, hate, swearing or expressions that may be otherwise offensive). You may not use the Service to engage in illegal activities or activities that violate the rights of others, provide information about illegal activities, or promote physical harm or injury against any group or individual.

b. You agree to immediately remove any information or content that you post or upload through the Service to which we object. We also reserve the right to remove them ourselves if necessary.

c. You represent and warrant that the information you provide when registering and all information you provide thereafter about yourself and your use of the Service is true and correct and not misleading.

d. You agree to behave reasonably at all times when interacting with our Coaches and others in connection with the Services or use of the Website, Applications or Services. We will not tolerate abusive or inappropriate behaviour by or towards other users of the Services. We will take all reasonable steps, which may include immediately terminating your access to the Service if we become aware of such problems.

f. We fully exclude Groupe Mutuel’s liability for any damages resulting from any unlawful use of the Services.

g. If a Coach, as a result of the coaching recommendations that he/she has given to a Client, believes that the Client requires more in-depth personalised support or therapy for which the Platform is not suitable, he/she must inform mynd.ch immediately (the “Notification of a Coach”). If a Coach wishes to establish a direct business relationship with a Client, he/she must inform mynd.ch via a Notification by a Coach and obtain express permission.

7. No alteration of the service

You may not use any robot, spider, scraper or other automated means to access the website, applications, content or services provided by the Service for any purpose. You may not post any content containing viruses, ransom demands, malicious software, Trojan horses, worms, time bombs, spiders or other computer programming routines or otherwise interfere with the Website, applications or service in any way that could damage, restrict, detrimentally interfere with, disable, surreptitiously intercept or expropriate (temporarily or permanently) any personal system, data or information. You may not attempt to make the Website, Applications or Service inaccessible through denial of service attacks or similar means or through any other means. You may not use contact information provided or obtained through the Website, Applications or Service to facilitate unsolicited mass communications such as SPAM or SPIM, or allow others to use your account for such actions or for any other reason.

8. Remuneration and Terms of Payment

We provide Users registered on the Platform with a portal designed to establish contacts between Coaches and Clients. Unless otherwise specified, our Services are subject to a fee. By registering on the Platform, a User accepts the fees for Services and the mynd.ch fee models.

a. With the exception of your first contact with mynd.ch as described under 4.b, the establishment of contacts between you and a Coach is subject to remuneration. The use of the Platform/Services is invoiced periodically. The monthly subscription starts with the first payment. It is automatically renewed as long as the contract is not terminated early by one of the parties. In the event of deletion of your user account, the remuneration for the Services for the current subscription is due.

b. The User makes the payment via a payment service provider who only transmits the data of the user making the payment to mynd.ch after it has been made anonymous.

c. The following payment methods are accepted: credit card and PayPal.

9. Service for non-commercial use

The Service is for the personal use of individuals only and may not be used in conjunction with commercial purposes. Organisations and companies may not use the Service without the express permission of Groupe Mutuel. You, as a user of the Service with individual business interests, may not solicit customers or advertise products or services in connection with the Site, the Applications or the Service or other users of the Service. Any content shared within the Site is not intended for external use or redistribution. Please direct media and research enquiries to info@mynd.ch.ch.

10. Service Password and Login Identity

You are responsible for maintaining the confidentiality of your password and login, and are fully responsible for all activities that occur under your password or account, whether or not such activities occur under your password or account, unless such activities are caused by our acts or omissions. If you knowingly provide your login information and password to another person, your rights of use and any access to the Service may be temporarily suspended or terminated. You agree to immediately notify Groupe Mutuel of any unauthorized use of your password or user login or any other breach of security by sending an e-mail to info@mynd.ch.

11. Creation of links to the site

a. You may create a link to the home page of the mynd.ch website (“the website”) at www.mynd.ch.ch provided that you do so in a fair and lawful manner and do not damage our reputation or profit from it. You may not create a link in a manner that suggests any form of association, approval or endorsement on our part if none exists. You may not create a link to this website from a website that is not owned by you. The Website must not appear as a data link on another website, and you may not create a link to any part of the Website other than the home page. The website from which you link to our site must comply in all respects with the obligations set out in these Terms of Use regarding acceptable and lawful use (see clause 6 above).

mynd.ch may contain links to other websites that are not under the control of Groupe Mutuel. Groupe Mutuel is not responsible for the content of third party sites or applications.

13. Suspension and termination of access to the service

a. The reasons why we may suspend your access to the Services, including the Site, the Applications or the Services include, but are not limited to, the following:

i. To resolve technical problems or make minor technical changes ;

ii. To update the Product to reflect changes in applicable laws and regulatory requirements ;

iii. To make changes to the Website, Application or Services ;

iv. To perform routine or emergency maintenance ;

We will endeavour to notify you of such suspensions in advance, but we do not guarantee access to or availability of the Service, including the Website, Applications or Services.

b. You agree that your account may be terminated immediately or your access to the Service may be restricted or terminated upon written notice if (i) you violate these Terms or misuse the Website, the Application or the Services ; (ii) we are required to do so by law enforcement or other governmental authorities; (iii) we receive a request from you (user-initiated termination); (iv) you fail to provide us with accurate and timely information that we request from you and that is necessary for your use of the Service.

c. We cannot guarantee the availability or suitability of the Website, the Application or the Services, or that the Website, the Application or the Services will be completely uninterrupted or error-free.

14. Changes to these Terms and Conditions

Groupe Mutuel reserves the right to amend these Terms of Use at any time without notice by publishing the amended Terms of Use on our website. You will nevertheless be informed of any changes to the clauses. We encourage you to review these Terms of Use regularly for updates or changes. Your continued use of the Site, Application or Services constitutes your acceptance of the amended Terms. Groupe Mutuel will also notify you, as a user of the Services, by e-mail of any material changes in the way we use personal information and, where required by law, will obtain your consent for the Services to make such changes.

The Mutual Group (including its subsidiaries, partners, contributors, agents, employees, directors or affiliates) hereby disclaims all express and implied conditions, warranties and representations to the fullest extent permitted by law, including, but not limited to, any implied conditions, warranties of fitness for a particular purpose, with respect to the Service, including the website, applications, content or services. Groupe Mutuel does not warrant that access to the service, including the web site, applications, content or services will be uninterrupted or error-free, or that defects will be corrected. We do not guarantee that the information we provide will meet your health or medical needs. It is up to you to consult a health care professional to discuss your concerns. If you are a healthcare professional, you may use this website for general information purposes. However, you should not rely on any material contained in this website and we assume no liability if you do so.

17. Disclaimer of Liability

To the fullest extent permitted by law, Groupe Mutuel (including its partners, contributors, agents, employees, directors or affiliates) excludes all liability for damages of any kind, including, without limitation, incidental, consequential and special damages:

ii. use of or reliance on Content accessed through the Service; or

iii. the unavailability of the Service; or

18. Applicable Law and Jurisdiction

a. These Terms and the contract entered into with you and any dispute or claim arising out of these Terms, the contract entered into with you or your use of the Service (including any non-contractual dispute or claim) shall be governed by and construed in accordance with Swiss law.

b. You agree that the Swiss courts shall have exclusive jurisdiction to settle any such dispute or claim.

19. Miscellaneous terms and conditions

a. You undertake not to use the mynd.ch logo in any way whatsoever without the prior written permission of Groupe Mutuel. With the exception of use of the Service in accordance with the terms and limitations of these Terms, you have no right to use any intellectual property in connection with mynd.ch services, and all such rights remain fully vested in Groupe Mutuel.

b. Groupe Mutuel may at any time transfer the agreement entered into with you to an affiliated company or, in the event of a merger, division, transformation or transfer of assets to a third party. You may not transfer the agreement you have entered into with us to a third party without our prior written consent.

c. If any provision of these Terms of Use or the agreement entered into with you is held to be unenforceable for any reason, the other provisions will not be affected and will remain in full force and effect.

Personal data we collect and use

How do we collect personal data?

We collect your personal data in two ways:

a. If you directly provide us with personal data. When you register on our site or application, subscribe to our services or communicate with us, you may choose to voluntarily provide us with certain information, e.g. by filling in text boxes or registration forms.

How long do we keep your data?

We retain your personal information for as long as necessary to provide the services or to comply with our legal obligations.
If required by law or reasonably necessary to resolve disputes, prevent fraud and abuse or enforce our terms of use, we may retain your personal information for longer periods.
In determining the appropriate retention period for your personal information, we will take into account the amount, nature and sensitivity of your personal information, the potential risk of harm resulting from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes by other means, and applicable laws.

Registration Forms

We do not sell or rent the personal information collected through the registration form to anyone.

Third parties that we have commissioned

We may share your personal data with our service providers to fulfill the purposes described above or to provide certain services to you.
We require all service providers we use to respect the security and confidentiality of your personal information and to process it in accordance with applicable law and only for specifically identified purposes and in accordance with our written instructions. We do not authorise our contracted service providers to use your personal data for their own purposes.

With regard to the information you have provided us with, you have the following possibilities of control. In order to verify your legitimacy, we will ask you in each case for proof of identity (copy of your identity card) if you contact us by e-mail.

– You can check the information you have submitted to mynd.ch by contacting our customer service department: dataprotection@mynd.ch.

– You can also contact us at any time via the same e-mail address to change, correct or delete personal information controlled by mynd.ch and contained in your profile. Please note, however, that if you have shared information with others through social media, this information may remain visible even after your account has been deleted.

– You are also free to close your account via the account settings. If you do so, your account will be deactivated. However, we may retain archived copies of certain information if required by law or our legitimate interests (including to help combat fraud and spam).

– You may update your personal information at any time either by changing it yourself or by emailing us at dataprotection@mynd.ch.

– You can unsubscribe from our marketing email list by clicking on the “Unsubscribe” link at the bottom of each email. Once you have done so, you will no longer receive marketing emails from us.

Data security

We have taken reasonable security measures to ensure that your personal information is not accidentally lost, used or accessed, altered or disclosed in an unauthorised manner.
